Owl Post Books Terms of Use

1. Acceptance of Terms
These Terms of Use govern your access to and use of owlpostbooks.com and shop.owlpostbooks.com (the “Sites”), and any services, subscriptions, or products offered by Owl Post Books (“Owl Post Books,” “we,” “us,” or “our”). By visiting, browsing, creating an account, or purchasing on the Sites, you agree to be bound by these Terms and our incorporated policies, including our Privacy Policy. If you do not agree, do not use the Sites or our services.
2. Who We Are
Owl Post Books provides children’s book subscription services and related products, including Imagination Box subscriptions (three books per month), Imagination Mini subscriptions (one book per month), and one-time purchases such as Grab Bags and Gift Boxes. We also operate official brand channels on Facebook, Instagram, Pinterest, TikTok, YouTube, and LinkedIn.
3. Where We Operate and Ship
We currently ship within the United States, including Alaska, Hawaii, and U.S. territories. We do not ship to Canada or other international locations at this time.
4. Eligibility
You must be at least 13 years old to use the Sites. If you are under 18, you may only use the Sites with the involvement and permission of a parent or legal guardian who is responsible for your use. You are responsible for complying with all applicable laws and these Terms.
5. Accounts and Security
To purchase or manage a subscription, you may need an account. You agree to provide accurate, current information and to keep it updated. You are responsible for maintaining the confidentiality of your login and for all activity under your account.

6. Sales Channels and Payments
We sell through our own website (Wix) and via Cratejoy. Payments are processed by third-party providers. Owl Post Books does not store full payment card details. You agree to pay all fees, taxes, and charges applicable to your order. Prices are listed in U.S. dollars and may change at any time.
Sales tax is applied to orders shipped within Texas and added at checkout. Orders to other U.S. states and territories are generally tax-free unless otherwise required by law.
7. Subscriptions and Auto-Renewals
Available plans include monthly, 3-month, 6-month, and 12-month terms. Subscriptions automatically renew at the then-current rate for your plan unless cancelled in accordance with these Terms.
Renewal date and time. Your next renewal date is displayed in your account dashboard and in renewal emails. Renewals currently process on or around the 18th of each month in U.S. Central Time. If your email provider filters or blocks our messages, you are still responsible for managing your subscription by logging into your dashboard.
Cancellations. You may cancel at any time before your next renewal processes by logging into your dashboard. Cancelling stops future renewals. It does not automatically cancel open orders, prepaid shipments already included in your term, or shipments that have been charged. For help with open orders, email info@owlpostbooks.com.
Prepaid plans. If you purchased a 3-month, 6-month, or 12-month prepaid plan, you will receive the remaining boxes in your term after cancellation, unless you make other arrangements with customer service.
8. One-Time Purchases
Grab Bags and Gift Boxes are one-time purchases and do not renew automatically. Shipping fees for one-time purchases are flat-rate and shown at checkout. One-time purchases typically ship within 7 business days.
9. Shipping and Delivery
Subscriptions include U.S. shipping in the price. We ship via USPS Media Mail. Typical transit is 3 to 7 business days, or 12 to 16 days for Alaska, Hawaii, and U.S. territories. Welcome Boxes generally ship within 5 business days of order.
Tracking. You will receive tracking by email from our shipping partner. Check your spam or junk folder if you do not see it. Title and risk of loss pass to you when we deliver your order to the carrier.
Undeliverable or missing packages. If tracking shows delivered but you do not have the package, first contact your local post office. Then email info@owlpostbooks.com so we can assist.
10. Cancellations, Returns, and Refunds
Contact us first. To request a refund or to return a package, email info@owlpostbooks.com before sending anything back. Refunds cannot be processed without contacting customer service.
Returns. If your request involves returning a shipped package, you are responsible for return shipping and must use a trackable method. Owl Post Books does not provide prepaid return labels. Refunds are issued after we receive and inspect the return in its original condition.
Fees that may apply. To recover reasonable costs already incurred, the following fees may apply:
• Restocking fee: 15% applied to boxes that have been opened or handled and are returned for a refund.
• Handling fee for prepaid plans: 15% applied when a prepaid plan is refunded in part after one or more shipments have already been fulfilled.
Shipping charges are non-refundable once a package has shipped.
Damage or defects. If an item arrives damaged or incomplete, email info@owlpostbooks.com with photos within seven days. We will replace the item or provide another appropriate resolution.
No exchanges for title preferences. Because boxes are curated and selections vary monthly, we cannot exchange books based on preference once shipped.
11. Product Descriptions and Availability
We aim to describe products accurately, but minor variations may occur. Contents vary by month and age range. We do not guarantee specific titles or items in any box.
12. Promotions, Gift Certificates, and Gifts
Promotions are subject to their posted terms and may change or end at any time. To redeem a gift certificate, enter the code during checkout. If you have trouble redeeming a code, email info@owlpostbooks.com and we can help apply it.

13. Communications and Marketing
By placing an order or creating an account, you may receive transactional emails (order confirmations, shipping notices, renewal reminders). You may also opt in to receive marketing emails; you can unsubscribe at any time using the link in those emails. Unsubscribing from marketing does not affect transactional communications.
14. Intellectual Property and User Content
All content on the Sites is owned by Owl Post Books or its licensors and protected by intellectual property laws. You may not use, copy, distribute, or create derivative works without permission.
If you post, upload, or submit content to our Sites or official social channels, you represent that you own the content or have permission to use it. By submitting content, you grant Owl Post Books a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content for our business purposes, consistent with our Privacy Policy.
15. Acceptable Use
You agree not to use the Sites for unlawful, harmful, or abusive activity; to interfere with the Sites’ operation; to attempt to access others’ accounts; or to post content that is infringing, illegal, or misleading. We may remove content, suspend accounts, or refuse service if we believe a violation has occurred.
16. Third-Party Services
We use third-party platforms and processors, including Wix and Cratejoy, for ecommerce, and others for payments and shipping. Your use of those services may be subject to their terms and privacy policies.
17. Disclaimer of Warranties
The Sites and services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow limitations on implied warranties, so these limitations may not apply to you.
18. Limitation of Liability
To the maximum extent permitted by law, Owl Post Books will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Sites or our services. Our total liability for any claim will not exceed the greater of one hundred U.S. dollars (US$100) or the amount you paid to Owl Post Books in the 12 months preceding the event giving rise to the claim. Some jurisdictions do not allow such limitations, so they may not apply to you.
19. Indemnification
You agree to indemnify and hold harmless Owl Post Books and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or your misuse of the Sites or services.
20. Dispute Resolution, Arbitration, and Venue
We aim to resolve concerns quickly. Please email info@owlpostbooks.com with your issue first.
If we cannot resolve a dispute informally, you and Owl Post Books agree to binding arbitration on an individual basis, administered by the American Arbitration Association (AAA) under its applicable consumer rules. The arbitration will take place in or near Hillsboro, Texas, unless we both agree to a different location or a remote proceeding.
Class actions and representative proceedings are not permitted. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief for that party’s individual claim.
Either party may bring qualifying claims in small claims court in Hillsboro, Texas. Issues relating to intellectual property or misuse of the Sites may be brought in court.
These Terms and any dispute are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-laws rules. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement.
21. Changes to the Sites or Terms
We may update products, pricing, and policies at any time. We may modify these Terms by posting an updated version on the Sites with a new “Last updated” date. Your continued use after changes are posted means you accept the updated Terms.
22. Termination
We may suspend or terminate access to the Sites or services at any time for any reason, including violation of these Terms. You may stop using the Sites at any time. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnity, and dispute resolution.

Questions or notices may be sent to info@owlpostbooks.com. If we need to contact you, we will use the email address associated with your account. If you provide a mailing address, we may send notice by postal mail.

24. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. No waiver of any provision is a waiver of any other provision, nor a continuing waiver. These Terms, together with our Privacy Policy and any posted policies or terms referenced here, are the entire agreement between you and Owl Post Books regarding your use of the Sites and services.
